In terms of safety, the characteristics of a medicinal product should be based on a comparative analysis of its effectiveness and the risk of harm to health.

By effectiveness - a characteristic of the degree of positive effect of a drug on the course, duration of the disease or its prevention, rehabilitation.

From the definition of “circulation of medicinal products” it becomes clear that different entities are involved in the circulation of medicinal products - from manufacturers, distributors of cosmetic products to managers of beauty salons and cosmetologists.

Circulation of medicinal products is development, preclinical studies, clinical studies, examination, state registration, standardization and quality control, production, manufacturing, storage, transportation, import into the territory of the Russian Federation, export from the territory of the Russian Federation, advertising, release, sale, transfer , use, destruction of medicines.

The relations of all entities involved in circulation are regulated by Federal Law No. 61 “On the Circulation of Medicines”.

It should be noted that now almost all companies - suppliers of cosmetic products - can be closed by a strong-willed political decision in one day only because today they are not subjects of pharmaceutical activity.

What is pharmaceutical activity?

This is an activity that includes wholesale trade in medicines, their storage, transportation and (or) retail trade in medicines, their dispensing, storage, transportation, and manufacturing of medicines.

But companies that supply cosmetic drugs are, according to the law, an organization of wholesale trade in medicines - an organization that carries out wholesale trade in medicines, their storage, transportation in accordance with the requirements of this Federal Law.

Order of the Ministry of Health and Social Development of the Russian Federation dated December 28, 2010 N 1222n approved the Rules for the wholesale trade of medicines for medical use for such supplier companies.

Only organizations that have a license for pharmaceutical activities with the obligatory indication “wholesale trade of medicines” on the territory of Russia have the legal right to sell medicines or transfer them in the manner established by the legislation of the Russian Federation to individual entrepreneurs or medical organizations. They, in turn, must have a license for pharmaceutical activities or a license for medical activities. And the organization itself is obliged to post a copy of the license for pharmaceutical activities for review.

The Rules prescribe the procedure for the sale of cosmetics (for cosmetic medicinal products).

An accompanying document is issued for medicines containing information:

• the date of execution of the accompanying document;
• on the name of the medicinal product (international nonproprietary name of the medicinal product and trade name of the medicinal product), expiration date and batch number;
• about the manufacturer of the medicinal product, indicating the name and location of the manufacturer;
• about the number of packages;
• about the supplier (taxpayer identification number, full name of the supplier, its location);
• about the buyer (taxpayer identification number, full name of the buyer, his location);
• about the official who drew up the accompanying document (position, full name).
• The document must be certified by the signature of the official who compiled the accompanying document, the seal of the organization or an information barcode and the seal of the organization.

Concepts used:

• A batch of a medicinal product is the quantity of a medicinal product produced as a result of one technological cycle by its manufacturer;
• Registration certificate is a document confirming the fact of state registration of a medicinal product;
• Registration number is a code designation assigned to a medicinal product during its state registration.

Bodies of Roszdravnadzor and the prosecutor's office, when checking the rules for the use of cosmetic preparations in beauty salons and cosmetology clinics, are already asking the heads of beauty industry enterprises to provide these documents. As a rule, it turns out that there is no such document, just as there is no license for the right to wholesale medicine from the company where the salon or clinic purchases fillers, botulinum toxin preparations or peeling products.

What exactly, today, of the many cosmetic preparations, is a medicinal product.

Preparations for mesotherapy, for contouring, as well as botulinum toxin preparations are medicines.

While botulinum toxin preparations are, for the most part, registered as medicines, mesotherapy preparations are generally imported as lotions for external use.

Chemical peels (both medium and deep) are also medicinal products, but are sold as cosmetic products without registration.

Preparations containing hyaluronic acid are used in the treatment of joints and burns, and they are also administered to rejuvenate the skin. But, for the most part, they do not have the appropriate documents.

Preparations for mesotherapy are mainly sold and imported into the Russian Federation as ampoule cosmetics for external use, but are used for subcutaneous administration.

Currently in the state. the register of medicines posted on the official portal of the Ministry of Health and Social Development of Russia includes drugs containing botulinum neurotoxin type A (Xeomin, Botox, Dysport, Lantox, etc.) as an active ingredient, as well as hyaluronic acid (Hyalgan Phidia). In addition to medical practice, these drugs are widely used in cosmetology.
